Scenario

Alia

Alia, a Certificate III Trainee has been working at the Children’s Centre for 6 months. Alia is progressing well and enjoys her work. She knows many of the families in the small community and feels comfortable talking to parents. Her supervisor Dana has cautioned Alia to maintain a professional relationship with parents rather than becoming too friendly.

It’s Sunday afternoon and Alia is at a BBQ with friends when the following conversation takes place.

Person A: “Hey Alia you know the Browns don’t you. Doesn’t one of their kids go to the Children’s Centre?”

Alia: “Yes, Thomas is in my group. He’s a gorgeous little boy.”

Person A: “So you’d know what’s going on in the family. I heard that Dallas Brown has run off with that lady from the Post Office. What’s the story?”

Alia (feeling a little uncomfortable): “Well, I can’t really say. I’m not allowed to discuss families outside of the centre. It’s centre policy.”

Person A: “Oh come on, don’t’ be such a goody two-shoes! We’re your friends remember?”

Person B: “Yeah, come on Alia. Spill!”

Alia looks down.

Person D: “Hey guys, leave Alia alone. She said she can’t talk about it and we should respect that. Just leave it.”

The others snigger and drift away.

Alia to Person D: “Thanks for helping me out. I was feeling really stressed. I have to respect the services confidentiality policy and procedures.”

Person D: “No worries. Those guys need to grow up a bit! They can be really stupid at times.”

What does Regulation 181 Confidentiality of records kept by approved provider state in relation to confidentiality?

It Ensure that the information kept in the record under these regulation is not divulged or communicated directly or indirectly to another person unless the following

It require to be given by or under the law

With the written consent of the person who provide that information

But my Assessor tell me that Q1 (A) Who else could information be divulged to? Please extend-Please revise and resubmit – you have not re-addressed this question

181 Confidentiality of records kept by approved provider

The approved provider of an education and care service must ensure that information kept in a record under these Regulations is not divulged or communicated, directly or indirectly, to another person other than-

(a) to the extent necessary for the education and care or medical treatment of the child to whom the information relates; or
(b) a parent of the child to whom the information relates, except in the case of information kept in a staff record; or
(c) the Regulatory Authority or an authorised officer; or
(d) as expressly authorised, permitted or required to be given by or under any Act or law; or
(e) with the written consent of the person who provided the information.
